Wakeboard Park Internal Rules and Safety Regulations

BEFORE STARTING THE ACTIVITY, PLEASE READ THE INFORMATION BELOW CAREFULLY AT ALL TIMES!

1. GENERAL PROVISIONS

1.1. These legally binding terms of use for the linear wakeboard cable park “Marupe Wake” (hereinafter – the Park) define the rules for the use and operation of the water area as a whole, including all structures and elements placed within the wakeboarding tracks, as well as the adjacent territories. The rules also establish the rights and obligations of the track users.

1.2. The legal relationship between the user of the Park (hereinafter – the Participant) and the owner of the Park, SIA “Beng”, registration No. 40103275560, operating under the service provider’s trademark “Marupe Wake” (hereinafter – the Owner), is governed by these Rules. These Rules come into force at the moment when a person, by expressing their will (i.e., by participating in the Activity), accepts the permission granted by the Owner or its authorized representatives to use the Park’s Track for riding on the water surface with a designated board/skis, holding onto a rope attached to an overhead cable line.

2. DEFINITIONS

4.1. Before beginning the ride and entering the Track, the Participant must read and familiarize themselves with the internal rules and safety regulations.

4.2. The Participant acknowledges and agrees to comply with these Rules and any instructions relating to initiating the ride, making turns, using structures, and observing safety protocols during the Activity. 4.3. It is strictly prohibited for the Participant to use the Track or participate in the Activity under the influence of alcohol, narcotics, or psychotropic substances.

4.4. The Participant agrees to select a riding speed (to be communicated to the Track staff before beginning the Activity) and a level of difficulty (use or avoidance of specific structures) that corresponds to their skills and experience, ensuring safety for themselves and others. The Participant undertakes to carefully assess their physical condition and technical ability before attempting to use any structure or perform a jump from height. By participating in the Activity and choosing to use obstacles and/or jump from elevated platforms, the Participant assumes full responsibility for their health and life in the event of injury or accident resulting from misjudgment of their abilities or due to falls or collisions. The Participant also assumes full responsibility for any injuries or health complications that occur or become apparent at any time after participating in the Activity. By participating, the Participant confirms they understand and accept the risk of physical injury and/or death.

4.5. The Participant agrees to follow all safety measures prescribed by the Owner (e.g., use of life jackets, helmets). These measures are indicated in the posted internal rules and safety regulations.

4.6. Basic swimming skills are mandatory for all Participants.

5. OWNER’S RIGHTS AND OBLIGATIONS

5.1. The Owner undertakes to equip the Track, ensure that all water-based structures are in proper working condition, display the usage and safety rules in visible locations, train the Track staff in operating the cable system and in communicating with Participants. Through these measures, the Owner provides the Participant with a safe and environmentally friendly Activity.

5.2. The Owner is not liable for damage or losses resulting from breaches of these Rules.

5.3. The Owner is not responsible for any damage, destruction, or theft of the Participant’s equipment, vehicles, or personal belongings during the use of the Track or its surrounding area.

6. PARTICIPANT’S LIABILITY

6.1. The Participant is personally morally and materially liable for their actions and omissions while on the Track, including any damage or loss caused by their conduct or failure to act — to themselves, third parties, or the Owner. This includes situations resulting from a misjudgment of their abilities or non-compliance with the rules of Track use.

6.2. The Participant assumes full responsibility for their own health and life and must ensure that any chosen maneuvers correspond to their abilities. This clause does not apply to cases related to the actions or omissions of the Owner.

6.3. The Owner is not liable for physical injuries, damage (material or non-material), or losses incurred on the Track if they are the result of violations or failure to comply with these Rules and/or the internal safety regulations. This clause does not restrict the Participant’s legal rights to submit claims related to the provided service.

6.4. The Participant is obliged to cease use of the Track if weather conditions or the state of the Track is clearly unsafe for use.

6.5. In case of non-compliance or violations of these Rules, the Track staff has the right to cancel the Participant’s allocated time and prohibit further use of the Track.

6.6. By choosing to participate in the Activity, the Participant confirms that they have read, fully understood, and accepted the terms of this agreement, and acknowledges full responsibility for their own health and life, including any injuries that may occur as a result of risks listed in clause 3.2 (but not limited to them).

6.7. The Participant must review the internal rules and safety regulations before each participation in the Activity.

7. SPECIAL PROVISIONS

7.1. During use of the Track, photographs, videos, or other audio-visual recordings may be taken for publicity purposes. Copyrights, distribution rights, and all other proprietary rights belong to the Owner. If the Participant does not wish for materials featuring them to be used publicly, they must notify the Owner in writing on site or via email.

7.4. By participating in the Activity, the Participant confirms that they have carefully read and understood all “Marupe Wake” Internal Rules and Safety Regulations, that the rules are fully clear and acceptable, and that — being aware of the risks and their physical abilities — they agree to comply with them.

7.5. This agreement is binding on the Owner, the Participant, their legal representatives, and any successors in rights and obligations.

7.6. These Rules may be amended without prior notice. The current version of the Rules is always available at Park reception and on the website. Participation in the Activity constitutes awareness of such changes.

7.7. These Rules are binding on all visitors to the Marupe Wake wakeboard park (hereinafter – the Park), regardless of whether they have read or signed them. Participation shall be deemed as express consent to all the rules, which have legal force even without the Participant’s separate signature — in accordance with the general legal principles of the Civil Law of the Republic of Latvia on voluntary assumption of obligations and the consequences of one’s actions.

SAFETY RULES

1. Familiarization with the Rules
Before using the Track and participating in the Activity, the Participant is required to carefully read and familiarize themselves with the internal rules and safety regulations set out below. By participating in the Activity, the Participant confirms that they have read, understood, and agree to comply with these rules. These rules have legal force and are binding upon every Participant, based on the principle of voluntary action.

2. Appropriate Equipment is Mandatory
While on the Track, the Participant must wear a properly fastened CE-certified life/impact vest and a helmet suitable for water sports. If the Participant does not have a personal life vest and/or helmet, they must request the necessary equipment from Park staff, who will provide it free of charge.

3. Basic Swimming Skills
The Participant must possess basic swimming skills. They are required to inform staff of their previous experience and preparedness. Participants without prior experience or who are unsure of their abilities must inform MWP staff before participating.

4. Wakeboarding is a Risky Activity
The Participant must acknowledge that wakeboarding is a high-risk activity that can result in serious physical injuries and/or death.

5. Always Ride in a Controlled and Responsible Manner
It is strictly prohibited to use the Track under the influence of alcohol or narcotic substances.

6. Ensure Good Auditory Awareness
Never ride while wearing audio earphones or headphones that limit hearing ability.

7. Health Conditions
If you have any health conditions, you must always inform the staff before entering the Track. Do not participate in the Activity if your condition may worsen or be aggravated as a result of participation.

8. Use of the Track – By Invitation Only
Participants may use the Track only after receiving a verbal invitation from MWP staff.

9. Minimum Age Requirement
Participants must be at least 18 years old. Participants under the age of 18 may use the Track only under the responsibility of their legal representative.

10. Swimming and Diving Restrictions
Swimming or diving in the Track area or between the Tracks is prohibited. Swimming is only allowed in the designated beach area located to the right of the riding Tracks.

11. Starting the Ride
If you are a beginner, the easiest way to start riding is from a seated position in the water. Always inform the staff if it is your first time riding and if you need assistance or training.

12. Ride Start Positions
A ride may be started from:
a) a seated position in the water (entire body submerged),
b) a seated position on the edge of the platform (legs and board in the water), or
c) a standing position at the edge of the platform (board no more than 0.5 m above the water surface).

13. Handle Grip
Always hold the handle with both hands. Never place the handle between your legs, around your neck, or insert your hand through the handle.

14. Turning Around
While riding, turning in the opposite direction must be done along the outer edge by going around the buoys placed in the water. If riding with the left foot forward, the left-side buoy must be passed on the left; if riding with the right foot forward, the right-side buoy must be passed on the right.

15. Let Go of the Handle in Case of a Fall
If you fall or lose your equipment, immediately let go of the handle, swim to retrieve your equipment, and then swim back to the handle. Never try to grab or hold onto a moving handle.

16. Restarting the Ride After a Fall
After a fall, the Participant should swim to the handle, grab it, assume the starting position, and raise one arm high to signal readiness to restart the ride.

17. Ending the Ride
If, after a fall, the Participant does not wish to continue the ride, they must signal by crossing and raising both arms in front of them.

18. Exiting to Shore
To end the ride and exit to shore, the Participant must lie on their stomach and hold the handle with both hands. The Participant must release the handle in time to avoid contact with the start platform. The Participant may also exit the water independently by swimming to shore.

19. Performing Acrobatics
During the ride, the Participant may perform acrobatic tricks of various difficulty levels only after carefully evaluating their abilities and fully understanding and accepting responsibility for any potential physical injuries resulting from such actions.

20. Use of Obstacles Only After Careful Assessment of Abilities
The obstacles installed in the water are intended for use only by experienced riders. Participants must carefully assess their physical fitness and skills before attempting to use any obstacle. By using obstacles, the Participant accepts full responsibility for their own health and life in case of injury or accident caused by incorrect assessment of their abilities and/or due to a fall or collision. In any case, we recommend starting with the simplest maneuvers on the obstacles.

21. Safe Direction of Use for Obstacles
Obstacles installed in the water may only be used in the designated safe direction — that is, starting from the low end. (An exception applies to obstacles that have both ends specially adapted and sloped.)

22. Passing Obstacles
If you do not wish to use an obstacle, try to pass it at as wide a distance as possible. If you approach the obstacle too closely and are unable to go around it, you must release the handle to avoid a collision.

23. Questions and Uncertainties
In case of any uncertainties or questions, immediately contact the MWP staff.

24. Careful Use of Provided Equipment
Participants must treat the provided equipment and gear with care. If the Participant notices any defect or issue with the equipment during use, they must immediately inform the MWP staff.

25. Informing About Jumps
Before starting the ride, the Participant must inform MWP staff if they intend to perform jumps from the water surface during turns and/or elsewhere on the course.

26. Adjusting Equipment During the Ride Is Prohibited
Participants are not allowed to adjust helmets, tighten bindings, or fasten life vests while riding. If such adjustments are necessary, the Participant must release the handle, stop completely, make the corrections, and only then resume the ride.

27. Strict Prohibition of Being in the Water During Thunderstorms
Participants must immediately exit the water if a thunderstorm is approaching or thunder is heard.

28. Reporting Accidents
In the event of any accident on the course, the Participant must immediately inform MWP staff. In case of an emergency, call 112.

29. Important!
By using the wakeboard course, you assume full responsibility for any harm to yourself, your health, and/or your equipment.
