Terms and Conditions for Online Ticket Purchase at the Active Recreation Park “Marupe Wake” (Distance contract – in accordance with Cabinet Regulation No. 255 “Regulations Regarding Distance Contracts”)

1. GENERAL TERMS AND TICKET PURCHASE

  1. The owner of the active recreation park “Marupe Wake” (hereinafter referred to as “Marupe Wake”) is SIA “Beng”, registration number 40103275560, legal address: Mazcenu aleja 6-37, Jaunmārupe, Mārupe Municipality, Latvia, LV-2166.
  2. Marupe Wake offers the opportunity to purchase tickets and gift cards for water-based recreational services – wakeboarding and/or access to the inflatable water park (hereinafter referred to as “Tickets”) – via the website udensatrakcijuparks.lv.
  3. Tickets can be purchased electronically on the website udensatrakcijuparks.lv, or on-site at the Marupe Wake ticket desk before using the services.
    Ticket purchases made on-site at the Mārupe Wake ticket desk do not constitute a distance contract and therefore are not subject to Cabinet Regulation No. 255 “Regulations Regarding Distance Contracts.” The terms outlined below apply only to online purchases.
  4. Tickets may only be purchased on-site during Marupe Wake’s official opening hours.
    As opening hours may vary depending on weather conditions and customer traffic, we recommend confirming the current schedule or any other inquiries by calling +371 22032923 or emailing info@marupewake.lv.
  5. Information about the available services, prices, terms, and restrictions is provided on the website udensatrakcijuparks.lv as well as on-site within the Marupe Wake park area.
  6. Persons who use the online ticket purchasing option via the website udensatrakcijuparks.lv to receive Marupe Wake’s services (hereinafter referred to as the Buyers) agree to comply with the ticket purchase and usage terms set out below.
  7. By purchasing Tickets online via the Mārupe Wake website udensatrakcijuparks.lv, the Buyer confirms that they have read and agree to the terms of the Distance Contract, which becomes binding upon completion of the Ticket purchase.
    The Distance Contract has been developed in accordance with the applicable laws and regulations of the Republic of Latvia.
  8. By purchasing a Ticket, the Buyer undertakes to:
  • Comply with the terms and conditions set out in this Distance Contract;
  • Follow Mārupe Wake’s internal rules and safety regulations, which are available on the website udensatrakcijuparks.lv and clearly displayed and accessible on-site at the Mārupe Wake territory;
  • When purchasing a Gift Card, observe the validity period, which is 12 (twelve) calendar months from the date of purchase, taking into account the seasonal operation and actual season length for each specific service.
    The Gift Card is not exchangeable for cash and will not be reissued in case of loss
  • Upon purchasing a Ticket for a selected service, respect the reserved time stated on the Ticket and arrive at Mārupe Wake at least 20–30 minutes in advance to allow time for preparation and familiarization with the safety rules of the chosen activity.
  • All prices on the website udensatrakcijuparks.lv are shown inclusive of 21{4821c52f3be3bddc7c830ad0a3dcbb66b999301714481f91a105eadf1bb728cc} value-added tax (VAT).

2. TICKET PURCHASE PROCEDURE AND LIABILITY OF THE PARTIES

  1. The Buyer purchases Tickets via the website udensatrakcijuparks.lv, selecting the desired Service, date and time of visit, duration, and, if applicable, indicating the number of persons who will use the Service.
  2. The Buyer is obliged to provide only true and complete information. The Buyer assumes full responsibility for the accuracy and correctness of the submitted information. Mārupe Wake is not responsible for any consequences arising from incorrect or intentionally false data submitted by the Buyer, including but not limited to: an incorrect email address for ticket delivery, an incorrect date or time of visit, the number of persons, etc.
  3. The Buyer is solely responsible for arriving on time at Mārupe Wake to receive the Service on the date and time indicated on the Ticket. If the Buyer is late for the reserved and paid time, arrives significantly late, or fails to appear, the Ticket will not be changed, refunded, or compensated in any form. Tickets are non-refundable.
  4. Mārupe Wake is responsible for ensuring the functionality and operation of the ticket sales and purchase process.
  5. It is also possible to make a reservation on Mārupe Wake’s website, selecting on-site payment at the ticket desk as the payment method. In this case, a reservation confirmation is sent to the Buyer’s email, but the Ticket must be purchased on-site. The Buyer has the right to cancel an unpaid reservation no later than 30 minutes before the reserved session time. If the Buyer fails to cancel the unpaid reservation and does not arrive, future reservations must be made via online ticket purchase with prepayment. One Buyer may make a reservation for up to 5 persons without online payment.
  6. The Buyer’s data is processed and stored in accordance with the laws and regulations of the Republic of Latvia.
  7. In cases where there are reasonable suspicions of fraudulent activity, Mārupe Wake reserves the right to cancel any online transaction or reservation.
  8. If the Buyer has any questions or uncertainties regarding the use of the online ticket purchase system at www.udensatrakcijuparks.lv, they may contact the Mārupe Wake administration by calling +371 22032923 or sending an email to info@marupewake.lv.
  9. After the purchase is completed and payment is received, the Tickets are automatically sent to the email address provided by the Buyer. If the Buyer does not receive the purchased Tickets due to technical issues, they must contact Mārupe Wake administration via phone or email.
  10. Mārupe Wake is not liable if the Ticket sent to the Buyer’s email becomes accessible to third parties and is used without the Buyer’s consent.

3. DATA PROCESSING

  1. The processing of personal data is carried out by the owner of “Mārupe Wake”, SIA “Beng”, in accordance with the requirements of the General Data Protection Regulation (EU) 2016/679 (hereinafter – the “Regulation”), as well as other applicable laws and regulations of the Republic of Latvia. The Buyer can review the Privacy Policy of “Mārupe Wake” on the company’s website udensatrakcijuparks.lv. The data provided by the Buyer is used solely for the purpose of: sending the Ticket, processing the reservation, and/or contacting the Buyer regarding the execution of the purchased Service or to clarify other information related to the purchase/reservation.
  2. By submitting information and data to “Mārupe Wake”, the Buyer confirms that they are the data subject or a person legally entitled to provide such data. By entering personal data for the purpose of purchasing Tickets, the Buyer agrees that “Mārupe Wake” processes the submitted data to the extent and under the conditions described in these terms. By entering the required information and placing an order, the Buyer confirms that they have read and agree to the use of their data in order for the Seller to accept the Buyer’s order and deliver the Tickets. By providing their information, the Buyer agrees that notifications related to their order will be sent to the specified email address.
  3. “Mārupe Wake” undertakes not to disclose the Buyer’s personal data to third parties, except in cases where such disclosure is required by law enforcement authorities in accordance with the laws and regulations of the Republic of Latvia.
  4. “Mārupe Wake” processes the Buyer’s personal data in compliance with applicable personal data protection requirements in order to provide ticket sales and purchase services. 4. RIGHT OF WITHDRAWAL

  1. In accordance with Clause 22.12 of the Cabinet of Ministers Regulation No. 255 “Regulations on Distance Contracts” of 20 May 2014, the consumer does not have the right of withdrawal if the distance contract is concluded for leisure or entertainment services to be provided on a specific date or within a specified period. Therefore, the purchase of tickets for “Mārupe Wake” services is not subject to the right of withdrawal provided for in the Consumer Rights Protection Law.
  2. Based on the above, tickets purchased from Mārupe Wake are non-refundable, non-exchangeable, and cannot be returned, except in cases when the service cannot be provided on the reserved date and time indicated on the ticket, due to technical reasons or safety concerns.
  3. If the service cannot be provided on the purchased and reserved date and time, Mārupe Wake will refund the amount paid for the electronic ticket within 15 (fifteen) working days to the Buyer’s specified bank account, upon receipt of a written refund request submitted in free form.
  4. The request must be sent to info@marupewake.lv and must include the unused ticket as an attachment. Once the ticket is returned to Mārupe Wake, it is annulled and becomes invalid for service use.
  5. Mārupe Wake will only refund the nominal value of the ticket. Any additional costs, such as service charges, travel expenses, or bank fees, will not be reimbursed.

5. OTHER TERMS

  1. The Buyer has the right to transfer the purchased Ticket or received Service to another person free of charge, at their own discretion, even if the Gift Card is personalized (e.g., contains the recipient’s name and surname).
  2. By purchasing Tickets/Services on the website www.udensatrakcijuparks.lv, the Buyer fully agrees to these terms.
  3. The purchase of a Ticket for any Service provided by the “Mārupe Wake” active recreation park confirms that the Buyer has read and agrees to comply with the internal rules and safety regulations of Mārupe Wake.
  4. Purchased Tickets may not be used for commercial purposes – including for advertising or marketing campaigns – without prior written permission from Mārupe Wake.
