Water Park Safety Rules and Internal Regulations

  1. SIA „Beng”, reg No. 40103275560, is the owner of the recreational complex “Marupe Wake” in “Bērzciema ūdenskrātuve”, Mārupe mun., Jaunmārupe.
  2. Safety rules (further in the text – Rules) must be followed by all Participants regardless of age. Before using the Water park, the person must read and understand the Safety regulations, undertake to comply with these regulations while using the Water park and must sign in the Water Park Safety and internal regulations journal/Form, declaring their acceptance of and compliance with these regulations and the disclaimer.
  3. The Water park safety rules and internal regulations are published in a freely accessible location in the “Marupe Wake” territory.
  4. For attention and better understanding, the Rules are also shown in an illustrative form with a written explanation at the bottom.

IN THE WATER, IT IS PROHIBITED TO:

  1. Use the Water park while under the influence of alcohol, drugs or other psychotropic substances;
  2. Dive, remain under water for a prolonged time;
  3. Stand in front of the slide;
  4. Swim under the structures or turn the structures upside down;
  5. Use the attractions while pregnant or if a person has serious health problems;
  6. Use the attractions while wearing jewelry, glasses or any other sharp objects;
  7. To slide down areas that have climbing handles attached;
  8. Push, wrestle or otherwise deliberately physically affect other Participants;
  9. Leave children under 10 years of age without adult supervision;
  10. Bring your own food/drinks in the “Marupe Wake” territory.

WATER AMUSEMENT PARK RULES:

  1. The Water park is open from 1 June until 1 September. Depending on the weather conditions, the season may start early and/or be extended;
  2. The water park is open from 10:00 to 21:00. Sessions start at every hour. By a prior agreement with the Owner, it is possible to visit the water park outside the business hours; however, only during the daylight hours;
  3. The duration of one session is 50 minutes and it is possible to book several consecutive sessions;
  4. An individual who has booked a session should arrive 30 minutes early to read the safety rules and receive a Participant’s bracelet;
  5. The Participant must assess his or her physical abilities, health and swimming skills before using the water park;
  6. The water park operation is overseen by an Instructor;
  7. The Participant must pay attention to the safety briefing and the Instructor’s guidance!
  8. The Participant must have basic swimming skills. Attention! The depth is deeper than 2 meters!
  9. The Participant must wear and properly secure a lifejacket.
  10. The Participant must be 6+ years old with a height of at least 110cm.
  11. Children under the age of 10 (inclusive) may use the water park only together with a parent or an adult and shall remain under strict supervision. The supervising adult must take full responsibility for the health and behavior of the child, as well as the compliance with these provisions. One adult may supervise not more than 2 children at the same time.
  12. The parents must always supervise their children and their activity in the Water park.
  13. The slides must always be used in a forward direction. In a position with arms crossed over the chest, feet and legs together. If you’re sliding down with a friend, don’t hold in hands. Slide separately!
  14. Always enter the water feet first. Do not dive headfirst into the water from any element of the track.
  15. Comply with the required safety distance from other participants!
  16. Younger children should always be given a priority.
  17. Never attempt to do activities if you are not confident about your abilities and skills!
  18. When running/jumping from one structure to another, first, make sure you will not collide with another Participant.
  19. Before jumping or sliding into the water, make sure that the water and the landing area are clear of other visitors.
  20. Always look up while climbing. Don’t step under someone who is stepping on top of you. People can slip and fall on you.
  21. Before sliding the obstacle, make sure that you/the sobstacle is wet! Sliding down a dry, heated surface can cause skin abrasions/burns.
  22. Do not attempt to swim under any of the structures. Always go over the top surface.
  23. The water park may be used while wearing appropriate socks or barefoot. Any other footwear is prohibited.
  24. Water Park may be used in the rain. During thunderstorms and lightning storms, it is strictly prohibited to use the water park and/or be in the water. In case of adverse weather conditions, the time of the booked session may be changed.
  25. In case a session is interrupted or cancelled due to unforeseen weather conditions, no refund will be issued. Instead, a voucher will be provided free of charge, allowing a rescheduled visit until the end of the season. By booking the service, the client confirms that they have read and agreed to these terms.
  26. The Owner shall not be liable for any damages, losses and injuries caused by accidents or other reasons due to:
    • Neglect, lack of attention or negligence of the Participants and/or guests;
    • Participant’s health impairment resulting from an acute illness, trauma or worsening of a chronic condition of the Participant;
    • Participant’s poor assessment of own abilities and physical fitness;
    • Breaches of safety regulations and/or improper compliance with the safety regulations by the participants and/or guests of the water park, including, as a result of non-compliance with the instructions of the water park employees.
  27. The Owner shall not be liable for the damage to the health and/or life of the Participant, not any damage and/or loss caused to the property of the Participant or the guests incurred by the Participant while in the territory of the water park, if such damage or loss is caused by third parties or other circumstances for which the Owner is not liable in accordance with these regulations and the law.
  28. The Owner shall not be liable for any loss, destruction or damages to the vehicles, clothing, documents, mobile phones and other physical property and valuables of the Participant during the use of the water park and the territory of the wakeboarding and recreation park “Marupe Wake Park”.

PARTICIPANT’S LIABILITY

  1. The use of the Water park requires physical effort and it may be a dangerous activity which causes a risk of physical injury and/or even death. The Participant fully understands and accepts the dangers by participating in the Activity.
  2. The Water park is made of unstable and slippery structures in the water, which can cause unexpected falls both – on the elements and in the water – therefore, before participating in the Activity, the Participant is obliged to carefully evaluate his suitability for the Activity: evaluate physical fitness, current state of health, past/current injuries , swimming skills, emotional readiness, etc.
  3. The risks and hazards associated with the Activity includes, but are not limited to: water currents, water tides, water course, depth of the water body, waves, wake, drowning, choking on water, being tangled in/caught on guywires, weather (for example, exposure to sun, wind and rain), slipping and falling, sudden failure of the equipment, presence of aquatic and other wild animals, emotional and psychological trauma after exposure to the above risks, negligence of other Participants and/or guests. The above list of risks is not exhaustive and the participation in the activity may be dangerous and involve other risks.
  4. The Participant is informed that during the use of the water park and the adjacent areas, the Participant may be photographed and video and other sound and visual recording may be made (including by use of unmanned aircrafts or drones) and the Owner may use such recordings at his discretion for publicity and advertising purposes. In this case, all copyright, distribution rights and other property rights are owned by the Owner. If the Participant does not want to be photographed or filmed, the Participant should notify the Instructor accordingly before signing the Journal/the Form.
  5. In the event of health and/or property damage, the Participant must immediately notify the Instructor.
  6. The Participant shall be liable for any and all damages and losses caused to the Owner or third parties (including unintentional damages).
  7. Any water park employee is entitled to give instructions to the Participant regarding the compliance with these regulations and the Participant must comply with such instructions.
  8. The administration of SIA “Beng” reserves the right to change the range of inflatable attractions at any time without prior notice. No participation fee discounts are applied in such cases.
  9. Any Participant who does not comply with the safety regulations, Water park safety and internal regulations, generally accepted norms of behavior and/or Instructor’s guidance may be expelled from the water park without refunding the participation fee.

Participation in activities requires physical effort and involves an increased risk of injury or even life-threatening harm. By taking part in the activities, you confirm that you are aware of the risks and accept full responsibility for your own and your child’s safety, health, and actions.

Marupe Wake (SIA “Beng”) assumes no liability for any losses, injuries, or health damage suffered by the Participant (including – accidents resulting from failure to follow instructor guidance, violation of safety rules, or carelessness, negligence, or intentional risky behavior by the Participant or their guests). By visiting the Park, you agree to comply with all safety regulations and confirm that you will act with due care.
