GENERAL PROVISIONS<\/strong><\/h3>\n<p data-start=\"156\" data-end=\"533\"><strong data-start=\"156\" data-end=\"164\">1.1.<\/strong> These legally binding terms of use for the linear wakeboard cable park \u201cMarupe Wake\u201d (hereinafter \u2013 the Park) define the rules for the use and operation of the water area as a whole, including all structures and elements placed within the wakeboarding tracks, as well as the adjacent territories. The rules also establish the rights and obligations of the track users.<\/p>\n<p data-start=\"535\" data-end=\"1158\"><strong data-start=\"535\" data-end=\"543\">1.2.<\/strong> The legal relationship between the user of the Park (hereinafter \u2013 the Participant) and the owner of the Park, SIA \u201cBeng\u201d, registration No. 40103275560, operating under the service provider\u2019s trademark \u201cMarupe Wake\u201d (hereinafter \u2013 the Owner), is governed by these Rules. These Rules come into force at the moment when a person, by expressing their will (i.e., by participating in the Activity), accepts the permission granted by the Owner or its authorized representatives to use the Park&#8217;s Track for riding on the water surface with a designated board\/skis, holding onto a rope attached to an overhead cable line.<\/p>\n<hr data-start=\"1174\" data-end=\"1177\" \/>\n<h3 data-start=\"107\" data-end=\"129\"><strong data-start=\"111\" data-end=\"129\">2. DEFINITIONS<\/strong><\/h3>\n<p data-start=\"131\" data-end=\"258\"><strong data-start=\"131\" data-end=\"139\">Park<\/strong> \u2013 the linear wakeboard cable park \u201cMarupe Wake\u201d, including all cable tracks and the structures installed in the water.<\/p>\n<p data-start=\"260\" data-end=\"658\"><strong data-start=\"260\" data-end=\"275\">Participant<\/strong> \u2013 a person who uses the services of the Park and has read and fully understood the terms and conditions of use of the linear wakeboard cable park. By taking part in the Activity, the person agrees to fully comply with the Rules. A Participant may be a person who is at least 18 years of age, or, in the case of a person under the age of 18, together with their legal representative. The legal representative, by being physically present, effectively gives consent either verbally or through their presence for the minor\u2019s participation in the Activity.<\/p>\n<p data-start=\"660\" data-end=\"886\"><strong data-start=\"660\" data-end=\"670\">Tracks<\/strong> \u2013 the three linear wakeboard cable tracks installed in the water body, together with all structures and elements placed in the water, or a specific individual cable track with its associated elements and structures.<\/p>\n<p data-start=\"888\" data-end=\"978\"><strong data-start=\"888\" data-end=\"900\">Activity<\/strong> \u2013 the use of the Park\u2019s services, as well as the use of any of its equipment.<\/p>\n<hr data-start=\"1174\" data-end=\"1177\" \/>\n<h3 data-start=\"123\" data-end=\"148\"><strong data-start=\"127\" data-end=\"148\">3. ACTIVITY RISKS<\/strong><\/h3>\n<p data-start=\"150\" data-end=\"436\"><strong data-start=\"150\" data-end=\"158\">3.1.<\/strong> The Participant agrees and understands that participating in the Activity may be dangerous and poses a risk of physical injury and\/or death. The Participant acknowledges that the Activity is inherently hazardous and fully accepts and understands the potential dangers involved.<\/p>\n<p data-start=\"438\" data-end=\"1172\"><strong data-start=\"438\" data-end=\"446\">3.2.<\/strong> The risks and hazards of the Activity include, but are not limited to: water currents, tides, flow of the water body, water depth, waves, wakes, drowning, water inhalation, entanglement with ropes or cables, collision with structures installed in the water, weather conditions (e.g., sun, wind, rain), slipping and falling, sudden equipment or machinery failure, presence of aquatic and wild animals, operator error at the control console, emotional or psychological distress resulting from any of the aforementioned risks, and negligence by other Participants and\/or guests. The Participant acknowledges and accepts that this list is not exhaustive and that participating in the Activity may involve other, unforeseen risks.<\/p>\n<hr data-start=\"1174\" data-end=\"1177\" \/>\n<h3 data-start=\"1179\" data-end=\"1220\"><strong data-start=\"1183\" data-end=\"1220\">4. PARTICIPANT\u2019S RESPONSIBILITIES<\/strong><\/h3>\n<p data-start=\"1222\" data-end=\"1381\"><strong data-start=\"1222\" data-end=\"1230\">4.1.<\/strong> Before beginning the ride and entering the Track, the Participant must read and familiarize themselves with the internal rules and safety regulations.<\/p>\n<p data-start=\"1383\" data-end=\"1704\"><strong data-start=\"1383\" data-end=\"1391\">4.2.<\/strong> The Participant acknowledges and agrees to comply with these Rules and any instructions relating to initiating the ride, making turns, using structures, and observing safety protocols during the Activity. The Participant is also obliged to follow the directions of the Track staff regarding the use of the Track.<\/p>\n<p data-start=\"1706\" data-end=\"1879\"><strong data-start=\"1706\" data-end=\"1714\">4.3.<\/strong> It is strictly prohibited for the Participant to use the Track or participate in the Activity under the influence of alcohol, narcotics, or psychotropic substances.<\/p>\n<p data-start=\"1881\" data-end=\"2894\"><strong data-start=\"1881\" data-end=\"1889\">4.4.<\/strong> The Participant agrees to select a riding speed (to be communicated to the Track staff before beginning the Activity) and a level of difficulty (use or avoidance of specific structures) that corresponds to their skills and experience, ensuring safety for themselves and others. The Participant undertakes to carefully assess their physical condition and technical ability before attempting to use any structure or perform a jump from height. By participating in the Activity and choosing to use obstacles and\/or jump from elevated platforms, the Participant assumes full responsibility for their health and life in the event of injury or accident resulting from misjudgment of their abilities or due to falls or collisions. The Participant also assumes full responsibility for any injuries or health complications that occur or become apparent at any time after participating in the Activity. By participating, the Participant confirms they understand and accept the risk of physical injury and\/or death.<\/p>\n<p data-start=\"2896\" data-end=\"3101\"><strong data-start=\"2896\" data-end=\"2904\">4.5.<\/strong> The Participant agrees to follow all safety measures prescribed by the Owner (e.g., use of life jackets, helmets). These measures are indicated in the posted internal rules and safety regulations.<\/p>\n<p data-start=\"3103\" data-end=\"3169\"><strong data-start=\"3103\" data-end=\"3111\">4.6.<\/strong> Basic swimming skills are mandatory for all Participants.<\/p>\n<hr data-start=\"1174\" data-end=\"1177\" \/>\n<h3 data-start=\"3176\" data-end=\"3217\"><strong data-start=\"3180\" data-end=\"3217\">5. OWNER\u2019S RIGHTS AND OBLIGATIONS<\/strong><\/h3>\n<p data-start=\"3219\" data-end=\"3599\"><strong data-start=\"3219\" data-end=\"3227\">5.1.<\/strong> The Owner undertakes to equip the Track, ensure that all water-based structures are in proper working condition, display the usage and safety rules in visible locations, train the Track staff in operating the cable system and in communicating with Participants. Through these measures, the Owner provides the Participant with a safe and environmentally friendly Activity.<\/p>\n<p data-start=\"3601\" data-end=\"3694\"><strong data-start=\"3601\" data-end=\"3609\">5.2.<\/strong> The Owner is not liable for damage or losses resulting from breaches of these Rules.<\/p>\n<p data-start=\"3696\" data-end=\"3889\"><strong data-start=\"3696\" data-end=\"3704\">5.3.<\/strong> The Owner is not responsible for any damage, destruction, or theft of the Participant\u2019s equipment, vehicles, or personal belongings during the use of the Track or its surrounding area.<\/p>\n<hr data-start=\"1872\" data-end=\"1875\" \/>\n<h3 data-start=\"110\" data-end=\"144\"><strong data-start=\"114\" data-end=\"144\">6. PARTICIPANT\u2019S LIABILITY<\/strong><\/h3>\n<p data-start=\"146\" data-end=\"503\"><strong data-start=\"146\" data-end=\"154\">6.1.<\/strong> The Participant is personally morally and materially liable for their actions and omissions while on the Track, including any damage or loss caused by their conduct or failure to act \u2014 to themselves, third parties, or the Owner. This includes situations resulting from a misjudgment of their abilities or non-compliance with the rules of Track use.<\/p>\n<p data-start=\"505\" data-end=\"746\"><strong data-start=\"505\" data-end=\"513\">6.2.<\/strong> The Participant assumes full responsibility for their own health and life and must ensure that any chosen maneuvers correspond to their abilities. This clause does not apply to cases related to the actions or omissions of the Owner.<\/p>\n<p data-start=\"748\" data-end=\"1096\"><strong data-start=\"748\" data-end=\"756\">6.3.<\/strong> The Owner is not liable for physical injuries, damage (material or non-material), or losses incurred on the Track if they are the result of violations or failure to comply with these Rules and\/or the internal safety regulations. This clause does not restrict the Participant\u2019s legal rights to submit claims related to the provided service.<\/p>\n<p data-start=\"1098\" data-end=\"1234\"><strong data-start=\"1098\" data-end=\"1106\">6.4.<\/strong> The Participant is obliged to cease use of the Track if weather conditions or the state of the Track is clearly unsafe for use.<\/p>\n<p data-start=\"1236\" data-end=\"1412\"><strong data-start=\"1236\" data-end=\"1244\">6.5.<\/strong> In case of non-compliance or violations of these Rules, the Track staff has the right to cancel the Participant\u2019s allocated time and prohibit further use of the Track.<\/p>\n<p data-start=\"1414\" data-end=\"1747\"><strong data-start=\"1414\" data-end=\"1422\">6.6.<\/strong> By choosing to participate in the Activity, the Participant confirms that they have read, fully understood, and accepted the terms of this agreement, and acknowledges full responsibility for their own health and life, including any injuries that may occur as a result of risks listed in clause 3.2 (but not limited to them).<\/p>\n<p data-start=\"1749\" data-end=\"1870\"><strong data-start=\"1749\" data-end=\"1757\">6.7.<\/strong> The Participant must review the internal rules and safety regulations before each participation in the Activity.<\/p>\n<hr data-start=\"1872\" data-end=\"1875\" \/>\n<h3 data-start=\"1877\" data-end=\"1906\"><strong data-start=\"1881\" data-end=\"1906\">7. SPECIAL PROVISIONS<\/strong><\/h3>\n<p data-start=\"1908\" data-end=\"2262\"><strong data-start=\"1908\" data-end=\"1916\">7.1.<\/strong> During use of the Track, photographs, videos, or other audio-visual recordings may be taken for publicity purposes. Copyrights, distribution rights, and all other proprietary rights belong to the Owner. If the Participant does not wish for materials featuring them to be used publicly, they must notify the Owner in writing on site or via email.<\/p>\n<p data-start=\"2264\" data-end=\"2631\"><strong data-start=\"2264\" data-end=\"2272\">7.2.<\/strong> Video surveillance is conducted on the premises. The purpose of personal data processing is to maintain order on the premises, prevent or detect criminal offenses, protect property, and ensure the vital interests of individuals. Data controller: Limited Liability Company \u201cBeng\u201d. Address: \u201cB\u0113rzciema \u016bdenskr\u0101tuve\u201d and \u201cDzirnas\u201d, M\u0101rupe Municipality, LV-2166.<\/p>\n<p data-start=\"2633\" data-end=\"2844\"><strong data-start=\"2633\" data-end=\"2641\">7.3.<\/strong> The Participant has the right to review these Rules at any time and must contact Park staff regarding any questions or uncertainties until all clauses of the agreement are fully understood and accepted.<\/p>\n<p data-start=\"2846\" data-end=\"3161\"><strong data-start=\"2846\" data-end=\"2854\">7.4.<\/strong> By participating in the Activity, the Participant confirms that they have carefully read and understood all \u201cMarupe Wake\u201d Internal Rules and Safety Regulations, that the rules are fully clear and acceptable, and that \u2014 being aware of the risks and their physical abilities \u2014 they agree to comply with them.<\/p>\n<p data-start=\"3163\" data-end=\"3303\"><strong data-start=\"3163\" data-end=\"3171\">7.5.<\/strong> This agreement is binding on the Owner, the Participant, their legal representatives, and any successors in rights and obligations.<\/p>\n<p data-start=\"3305\" data-end=\"3522\"><strong data-start=\"3305\" data-end=\"3313\">7.6.<\/strong> These Rules may be amended without prior notice. The current version of the Rules is always available at Park reception and on the website. Participation in the Activity constitutes awareness of such changes.<\/p>\n<p data-start=\"3524\" data-end=\"3996\"><strong data-start=\"3524\" data-end=\"3532\">7.7.<\/strong> These Rules are binding on all visitors to the Marupe Wake wakeboard park (hereinafter \u2013 the Park), regardless of whether they have read or signed them. Participation shall be deemed as express consent to all the rules, which have legal force even without the Participant\u2019s separate signature \u2014 in accordance with the general legal principles of the Civil Law of the Republic of Latvia on voluntary assumption of obligations and the consequences of one\u2019s actions.<\/p>\n<hr data-start=\"1872\" data-end=\"1875\" \/>\n<hr data-start=\"1872\" data-end=\"1875\" \/>\n<h2 style=\"text-align: center;\"><strong>SAFETY RULES<\/strong><\/h2>\n<p><strong data-start=\"67\" data-end=\"104\">1. Familiarization with the Rules<\/strong><br data-start=\"104\" data-end=\"107\" \/>Before using the Track and participating in the Activity, the Participant is required to carefully read and familiarize themselves with the internal rules and safety regulations set out below. By participating in the Activity, the Participant confirms that they have read, understood, and agree to comply with these rules. These rules have legal force and are binding upon every Participant, based on the principle of voluntary action.<\/p>\n<p data-start=\"80\" data-end=\"423\"><strong data-start=\"80\" data-end=\"121\">2. Appropriate Equipment is Mandatory<\/strong><br data-start=\"121\" data-end=\"124\" \/>While on the Track, the Participant must wear a properly fastened CE-certified life\/impact vest and a helmet suitable for water sports. If the Participant does not have a personal life vest and\/or helmet, they must request the necessary equipment from Park staff, who will provide it free of charge.<\/p>\n<p data-start=\"425\" data-end=\"707\"><strong data-start=\"425\" data-end=\"453\">3. Basic Swimming Skills<\/strong><br data-start=\"453\" data-end=\"456\" \/>The Participant must possess basic swimming skills. They are required to inform staff of their previous experience and preparedness. Participants without prior experience or who are unsure of their abilities must inform MWP staff before participating.<\/p>\n<p data-start=\"709\" data-end=\"884\"><strong data-start=\"709\" data-end=\"748\">4. Wakeboarding is a Risky Activity<\/strong><br data-start=\"748\" data-end=\"751\" \/>The Participant must acknowledge that wakeboarding is a high-risk activity that can result in serious physical injuries and\/or death.<\/p>\n<p data-start=\"886\" data-end=\"1043\"><strong data-start=\"886\" data-end=\"943\">5. Always Ride in a Controlled and Responsible Manner<\/strong><br data-start=\"943\" data-end=\"946\" \/>It is strictly prohibited to use the Track under the influence of alcohol or narcotic substances.<\/p>\n<p data-start=\"1045\" data-end=\"1167\"><strong data-start=\"1045\" data-end=\"1082\">6. Ensure Good Auditory Awareness<\/strong><br data-start=\"1082\" data-end=\"1085\" \/>Never ride while wearing audio earphones or headphones that limit hearing ability.<\/p>\n<p data-start=\"49\" data-end=\"281\"><strong data-start=\"49\" data-end=\"73\">7. Health Conditions<\/strong><br data-start=\"73\" data-end=\"76\" \/>If you have any health conditions, you must always inform the staff before entering the Track. Do not participate in the Activity if your condition may worsen or be aggravated as a result of participation.<\/p>\n<p data-start=\"283\" data-end=\"417\"><strong data-start=\"283\" data-end=\"327\">8. Use of the Track \u2013 By Invitation Only<\/strong><br data-start=\"327\" data-end=\"330\" \/>Participants may use the Track only after receiving a verbal invitation from MWP staff.<\/p>\n<p data-start=\"419\" data-end=\"607\"><strong data-start=\"419\" data-end=\"449\">9. Minimum Age Requirement<\/strong><br data-start=\"449\" data-end=\"452\" \/>Participants must be at least 18 years old. Participants under the age of 18 may use the Track only under the responsibility of their legal representative.<\/p>\n<p data-start=\"609\" data-end=\"822\"><strong data-start=\"609\" data-end=\"649\">10. Swimming and Diving Restrictions<\/strong><br data-start=\"649\" data-end=\"652\" \/>Swimming or diving in the Track area or between the Tracks is prohibited. Swimming is only allowed in the designated beach area located to the right of the riding Tracks.<\/p>\n<p data-start=\"824\" data-end=\"1042\"><strong data-start=\"824\" data-end=\"849\">11. Starting the Ride<\/strong><br data-start=\"849\" data-end=\"852\" \/>If you are a beginner, the easiest way to start riding is from a seated position in the water. Always inform the staff if it is your first time riding and if you need assistance or training.<\/p>\n<p data-start=\"1044\" data-end=\"1353\"><strong data-start=\"1044\" data-end=\"1072\">12. Ride Start Positions<\/strong><br data-start=\"1072\" data-end=\"1075\" \/>A ride may be started from:<br data-start=\"1102\" data-end=\"1105\" \/>a) a seated position in the water (entire body submerged),<br data-start=\"1163\" data-end=\"1166\" \/>b) a seated position on the edge of the platform (legs and board in the water), or<br data-start=\"1248\" data-end=\"1251\" \/>c) a standing position at the edge of the platform (board no more than 0.5 m above the water surface).<\/p>\n<p data-start=\"1355\" data-end=\"1516\"><strong data-start=\"1355\" data-end=\"1374\">13. Handle Grip<\/strong><br data-start=\"1374\" data-end=\"1377\" \/>Always hold the handle with both hands. Never place the handle between your legs, around your neck, or insert your hand through the handle.<\/p>\n<p data-start=\"50\" data-end=\"376\"><strong data-start=\"50\" data-end=\"72\">14. Turning Around<\/strong><br data-start=\"72\" data-end=\"75\" \/>While riding, turning in the opposite direction must be done along the outer edge by going around the buoys placed in the water. If riding with the left foot forward, the left-side buoy must be passed on the left; if riding with the right foot forward, the right-side buoy must be passed on the right.<\/p>\n<p data-start=\"378\" data-end=\"611\"><strong data-start=\"378\" data-end=\"424\">15. Let Go of the Handle in Case of a Fall<\/strong><br data-start=\"424\" data-end=\"427\" \/>If you fall or lose your equipment, immediately let go of the handle, swim to retrieve your equipment, and then swim back to the handle. Never try to grab or hold onto a moving handle.<\/p>\n<p data-start=\"613\" data-end=\"815\"><strong data-start=\"613\" data-end=\"653\">16. Restarting the Ride After a Fall<\/strong><br data-start=\"653\" data-end=\"656\" \/>After a fall, the Participant should swim to the handle, grab it, assume the starting position, and raise one arm high to signal readiness to restart the ride.<\/p>\n<p data-start=\"817\" data-end=\"981\"><strong data-start=\"817\" data-end=\"840\">17. Ending the Ride<\/strong><br data-start=\"840\" data-end=\"843\" \/>If, after a fall, the Participant does not wish to continue the ride, they must signal by crossing and raising both arms in front of them.<\/p>\n<p data-start=\"983\" data-end=\"1289\"><strong data-start=\"983\" data-end=\"1007\">18. Exiting to Shore<\/strong><br data-start=\"1007\" data-end=\"1010\" \/>To end the ride and exit to shore, the Participant must lie on their stomach and hold the handle with both hands. The Participant must release the handle in time to avoid contact with the start platform. The Participant may also exit the water independently by swimming to shore.<\/p>\n<p data-start=\"1291\" data-end=\"1579\"><strong data-start=\"1291\" data-end=\"1320\">19. Performing Acrobatics<\/strong><br data-start=\"1320\" data-end=\"1323\" \/>During the ride, the Participant may perform acrobatic tricks of various difficulty levels only after carefully evaluating their abilities and fully understanding and accepting responsibility for any potential physical injuries resulting from such actions.<\/p>\n<p data-start=\"50\" data-end=\"603\"><strong data-start=\"50\" data-end=\"117\">20. Use of Obstacles Only After Careful Assessment of Abilities<\/strong><br data-start=\"117\" data-end=\"120\" \/>The obstacles installed in the water are intended for use only by experienced riders. Participants must carefully assess their physical fitness and skills before attempting to use any obstacle. By using obstacles, the Participant accepts full responsibility for their own health and life in case of injury or accident caused by incorrect assessment of their abilities and\/or due to a fall or collision. In any case, we recommend starting with the simplest maneuvers on the obstacles.<\/p>\n<p data-start=\"605\" data-end=\"857\"><strong data-start=\"605\" data-end=\"648\">21. Safe Direction of Use for Obstacles<\/strong><br data-start=\"648\" data-end=\"651\" \/>Obstacles installed in the water may only be used in the designated safe direction \u2014 that is, starting from the low end. (An exception applies to obstacles that have both ends specially adapted and sloped.)<\/p>\n<p data-start=\"859\" data-end=\"1098\"><strong data-start=\"859\" data-end=\"884\">22. Passing Obstacles<\/strong><br data-start=\"884\" data-end=\"887\" \/>If you do not wish to use an obstacle, try to pass it at as wide a distance as possible. If you approach the obstacle too closely and are unable to go around it, you must release the handle to avoid a collision.<\/p>\n<p data-start=\"1100\" data-end=\"1215\"><strong data-start=\"1100\" data-end=\"1135\">23. Questions and Uncertainties<\/strong><br data-start=\"1135\" data-end=\"1138\" \/>In case of any uncertainties or questions, immediately contact the MWP staff.<\/p>\n<p data-start=\"1217\" data-end=\"1449\"><strong data-start=\"1217\" data-end=\"1258\">24. Careful Use of Provided Equipment<\/strong><br data-start=\"1258\" data-end=\"1261\" \/>Participants must treat the provided equipment and gear with care. If the Participant notices any defect or issue with the equipment during use, they must immediately inform the MWP staff.<\/p>\n<p data-start=\"1451\" data-end=\"1646\"><strong data-start=\"1451\" data-end=\"1480\">25. Informing About Jumps<\/strong><br data-start=\"1480\" data-end=\"1483\" \/>Before starting the ride, the Participant must inform MWP staff if they intend to perform jumps from the water surface during turns and\/or elsewhere on the course.<\/p>\n<p data-start=\"1648\" data-end=\"1954\"><strong data-start=\"1648\" data-end=\"1705\">26. Adjusting Equipment During the Ride Is Prohibited<\/strong><br data-start=\"1705\" data-end=\"1708\" \/>Participants are not allowed to adjust helmets, tighten bindings, or fasten life vests while riding. If such adjustments are necessary, the Participant must release the handle, stop completely, make the corrections, and only then resume the ride.<\/p>\n<p data-start=\"81\" data-end=\"251\"><strong data-start=\"81\" data-end=\"150\">27. Strict Prohibition of Being in the Water During Thunderstorms<\/strong><br data-start=\"150\" data-end=\"153\" \/>Participants must immediately exit the water if a thunderstorm is approaching or thunder is heard.<\/p>\n<p data-start=\"253\" data-end=\"412\"><strong data-start=\"253\" data-end=\"280\">28. Reporting Accidents<\/strong><br data-start=\"280\" data-end=\"283\" \/>In the event of any accident on the course, the Participant must immediately inform MWP staff. In case of an emergency, call 112.<\/p>\n<p data-start=\"414\" data-end=\"558\"><strong data-start=\"414\" data-end=\"432\">29.
